What happens with a final paycheck for my terminated Employee? 

Special processing may be needed for the final paycheck of an employee whose employment terminates. Although the FLSA does not require immediate payment of an employee’s final pay, many states impose time limits on when the employee’s final pay must be issued and impose penalties for an employer’s failure to provide the pay within that timeframe. 

Are Employers required to pay out for vacation or sick time? 
  • Many employers have policies that allow employees to accrue vacation time, and those employers pay the accrued vacation time with that final pay.  

  • The FLSA does not require employers to pay employees for vacation time; however, some state laws may require the payment of accrued vacation pay to a terminating employee.
