Additional Earnings: Paid time off
How do additional earnings work with Paid Time Off?
-
The FLSA does not require employers to pay employees for days or hours not worked such as holidays (e.g., Christmas or Independence Day), vacation, or sick time.
-
The FLSA also does not require employers to pay employees for unused sick days, holidays or vacation days or pay a premium to employees who work on holidays (although many companies have such policies). Under the FLSA, holiday, vacation, and sick pay hours are not counted in determining the regular rate of pay for overtime.
Is paid time off required to be paid to Employees?
Some states and localities require employers to provide sick leave hours to employees. This is dependent on state laws for sick leave requirements. For more information on paid sick leave requirements, look up state local paid sick leave requirements.
