How Zenefits handles location specific sick leave requirements

Administrators will need to comply with location-specific sick leave laws. Zenefits will inform them of these sick leave requirements but will not manage them automatically.

Please note that all updates to sick leave laws should be verified with the specific location. Any questions should be routed to your state's labor jurisdiction.

Zenefits will show the following messages to administrators based on the location.

  • Connecticut: Paid sick leave is only required for employers with more than 50 employees.
    • If companies have 50 or more employees: In Connecticut, companies with at least 50 employees must offer at least 40 hours of sick leave.
  • Jersey City, NJ:
    • If companies have 10 or more employees: In Jersey City, companies with at least 10 employees must offer at least 40 hours of sick leave.
    • Employers with fewer than 10 employees must provide at least 24 hours of paid sick leave and 16 hours of unpaid sick leave.
  • New York City:
    • If companies have 5 or more employees: In New York City, companies with at least 5 employees must offer at least 40 hours of sick leave.
    • If a company has fewer than 5 employees, the employer must still offer 40 hours of sick leave but it can be unpaid.
  • San Francisco, CA: These are general accrual caps and employees could use more than the 40 or 72 hours annually.
    • If companies have less than 10 employees: In San Francisco, companies with fewer than 10 employees must offer at least 40 hours of sick leave.
    • If companies have 10 or more employees: In San Francisco, companies with at least 10 employees must offer at least 72 hours of sick leave.
  • Seattle: Seattle’s tiers include employees employed anywhere in the U.S.
    • If companies have less than 50 employees: In Seattle, companies with fewer than 50 employees must offer at least 40 hours of sick leave.
    • If companies have 50 or more employees: In Seattle, companies with at least 50 employees must offer at least 56 hours of sick leave.
    • Employers with 250 or more employees must provide 72 hours of paid sick leave.
  • Tacoma, WA:
    • All employers must provide at least 24 hours of paid sick leave.
  • Oregon:
    • Employers with 10 or more employees must provide 40 hours sick leave.
    • Employers with fewer than 10 employees can provide unpaid sick leave (unless in Portland where the threshold is 6).
  • Philadelphia, PA:
    • Employers with 10 or more employees must provide at least 40 hours of paid sick leave.
  • Portland, Oregon: The Portland ordinance only applies to employers with 6 or more employees. Those employers with fewer than 6 employees can provide unpaid sick leave.
    • In Portland, all companies with 6 or more employees must offer at least 40 hours of sick leave.
  • Washington D.C.: The D.C. ordinance only counts employees employed within D.C..
    • If companies have less than 25 employees: In Washington D.C., companies with less than 25 employees must offer at least 24 hours of sick leave.
    • If companies have between 25 and 99 employees: In Washington D.C., companies with 25 to 99 employees must offer at least 40 hours of sick leave.
    • If companies have over 100 employees: In Washington D.C., companies with more than 100 employees must offer at least 56 hours of sick leave.

For employers with one or more locations on this list, Zenefits will display a banner with specific guidance on the overriding governance on the Sick & Personal Leave settings page.

Additional California-specific guidelines:

  • California-wide: Companies must provide a minimum of 24 hours for all employees working in CA.
  • Emeryville, CA:
    • Employers with 55 or fewer employees must provide 48 hours of sick leave;
    • Employers with greater than 55 employees must provide 72 hours of sick leave.
  • Oakland, CA: Companies must provide a minimum of 72 hours of sick leave for all employees

Additional New Jersey-specific guidelines:

  • Bloomfield, East Orange, Elizabeth, Irvington, Montclair, Newark, Passaic, Paterson, and Trenton.
    • Employers with 10 or more employees must provide 40 hours of paid sick leave.
    • Employers with fewer than 10 employees can provide unpaid sick leave.
  • New Brunswick, NJ.
    • Employers with 10 or more employees must provide 40 hours.
    • Employers with less than 10 employees must provide 24 hours of paid sick leave and 16 hours of unpaid sick leave.

Companies in Oakland and San Francisco must comply with the more generous policy (either city or state ordinance). However, Zenefits currently only overrides the amount provided to employees in San Francisco.
