Time & Attendance compliance with state overtime regulations

Time & Attendance helps administrators comply with overtime requirements by pre-configuring basic overtime calculations directly in the system. Below is a chart that sets forth all of the state overtime regulations in various jurisdictions.

State Overtime Laws and Requirements

The federal baseline for overtime is 1.5 x RRP for all hours over 40 in a week

Explanation

Alabama

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Alaska

  • 1.5 x RRP for all hours over 40 in a week
  • 1.5 x RRP for all hours over 8 in a day

Employees will be eligible to earn overtime on a daily and weekly basis:
Overtime on a weekly basis:
Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times the regular rate of pay.
Overtime on a daily basis:
Employees who work more than 8 hours during a workday, will earn overtime paid at 1.5 times their regular rate of pay.

Arizona

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Arkansas

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

California

  • 1.5 x RRP for all hours over 8 in a day
  • 1.5 x RRP for all hours over 40 in a week
  • 2 x RRP for all hours over 12 a day
  • 1.5 x RRP for the first 8 hours of work on the 7th day of work in any workweek, regardless of the number of hours worked during the previous 6 days
  • 2 x RRP for all hours over 8 on the 7th day

Employees will be eligible to earn overtime on a daily and weekly basis:
For overtime on a daily basis:
Employees who work more than 8 hours, they will earn overtime paid at 1.5 times the regular rate of pay.
Employees who work more than 12 hours, they will earn overtime paid at 2 times the regular rate of pay.
On the 7th consecutive day an employee works, for the first 8 hours, they will earn overtime pay at 1.5 times their regular rate of pay - for any hours they work over the first 8, they will earn overtime at 2 times their regular rate of pay.

For overtime on a weekly basis:
Employees who work over 40 hours during the workweek will earn overtime paid at 1.5 times the regular rate of pay.

Colorado

  • 1.5 x RRP for all hours over 12 in a day
  • 1.5 x RRP for all hours over 12 hours without regard to starting and ending time of the workday, whichever calculation results in the greatest payment of wages
  • 1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on an hourly, daily and weekly basis.
Overtime on an hourly basis:
Employees who work 12 or more consecutive hours, will earn overtime at 1.5 times their regular rate of pay.
Overtime on a daily basis:
Employees who work 12 or more hours during a workday will earn overtime paid at 1.5 times their regular rate of pay.
Overtime on a weekly basis
Employees who work over 40 hours during a work week will earn 1.5 times their regular rate of pay.

Connecticut

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

District of Columbia (DC)

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Delaware

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Florida

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Georgia

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Hawaii

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Idaho

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Illinois

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Indiana

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Iowa

1.5 x RRP for all hours over 40 in a week.

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Kansas

1.5 x RRP for all hours over 40 in a week

Employees and employers who are covered by the Fair Labor Standards Act (FLSA), which is federal law, are not covered by this law.

Kentucky

  • 1.5 x RRP for all hours on the 7th day of a week
  • 1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a daily and weekly basis.

Overtime on a daily basis:
If an employee works 7 consecutive days during a workweek, they will earn overtime paid at 1.5 times their regular rate of pay for any hours they work on that seventh day.
Overtime on a weekly basis:
For all hours an employee works over 40 hours during a workweek, they will earn overtime paid at 1.5 times their regular rate of pay.

Louisiana

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Maine

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Maryland

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Massachusetts

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Michigan

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Minnesota

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Mississippi

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Missouri

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Montana

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Nebraska

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Nevada

Nevada overtime is paid at 1 .5X the RRP.

Employees who earn LESS than 1.5X Nevada minimum wage must be paid overtime for time worked over 8 hours in a consecutive 24-hour period. 
Employees who earn MORE than 1.5X Nevada minimum wage must be paid overtime for time worked over 40 hours in a week. 

The only exception is if an employee agrees to work 4 10 hour shifts.

Nevada exempts certain workers and industries from overtime requirements.
Nevada has a 2 tier minimum wage system. Employers who offer Nevada qualifying health benefits to their employees are entitled to pay a lower minimum page. New Hampshire

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 x the minimum hourly wage rate for all hours over 40 in a week.

New Jersey

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

New Mexico

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

New York

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

North Carolina

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

North Dakota

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Ohio

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Oklahoma

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Oregon

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Pennsylvania

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Rhode Island

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

South Carolina

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

South Dakota

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Tennessee

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Texas

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Utah

1.5 x RRP for all hours over 40 in a week

Employees will be eligible to earn overtime on a weekly basis. Employees who work over 40 hours during a workweek will earn overtime paid at 1.5 times their regular rate of pay.

Vermont

1.5 x RRP for all hours over 40 in a week

Virginia

1.5 x RRP for all hours over 40 in a week
